Subject: This opinion piece exposes the lies perpetuated by Republican Rick Gray and RCSC General Manager Jan Ek in order to get RCSC pulled out of the planned communities act.  They want CLOSED MEETINGS AND CLOSED RECORDS!  They want to discredit a respected Superior Court Judge's ruling that RCSC is under the Act since 1994.  They are trying to escape facing the consequences of disobeying the Act since its inception.  DO NOT BE DUPED! VOTE NO ON SB1094!

HB2374 IS NOT DEAD!  SNEAKED UP AS SB1094!!

Late 3/25/19 this bill number showed up on the Agenda for the House Government Committee with hundreds of FOR votes when the bill wasn't even seen by anyone.  We suspect someone signed up people without their knowledge. 

By voting "FOR", the voter is saying he wants CLOSED MEETINGS AND CLOSED RECORDS at RCSC.  See if your name or that of anyone you know is on the list.

If SB1094 passes, these people's names will go down in infamy.  They are personally responsible for the total loss of membership power in Sun City.

HB2374 IS DEAD!

Thank you, Senator David Farnsworth for not allowing this bill to be heard in the Senate Government Committee, which killed the bill.

It's a win-win for those FOR and AGAINST.  Those who were FOR wanted Sun City to remain a 55+ community.  Those who were AGAINST wanted open meetings and open records.  Since the planned communities act will not remove the age overlay, remaining in it will have no negative effect in that regard.  Therefore, RCSC will remain in the PCA as it has always been since the act began in 1994.  RCSC just didn't comply is all.  Until our lawsuit.

Subject: Attend RCSC Board meeting at Sundial Auditorium, 9am, Thursday, March  28, 2019, to protest this expenditure since it requires a membership vote according to Article X of the RCSC Articles of Incorporation.  This is at issue in an ongoing lawsuit.  Why is the board choosing to do this now?  The hearing is set for August 2019.  Also, at issue is the PIF Fund.  They shouldn't be spending it.  It may have to be returned.

  STOP HB2374!!!  CALL TO ACTION! The Recreation Centers of Sun City, Inc., (RCSC) got Representative Kevin Payne (District 21) to pull them out of the planned communities act!! The bill has moved to the Senate Government Committee.  We expect dirty tricks like at the House where they changed the time so we couldn't speak. See testimony from that hearing where they read off our names to speak but not one of us is there.  Then, go to Jan Ek's testimony and the lobbyist saving her when she couldn't answer the question why Judge Brodman is wrong when he ruled RCSC is under the PCA.

STOP HB2374!!!  CALL TO ACTION! The Recreation Centers of Sun City, Inc., (RCSC) got Representative Kevin Payne (District 21) to pull them out of the planned communities act!!

SUMMARY: HB2374 removes RCSC from the planned communities act.  Plaintiffs won in Court.  The Judge found RCSC is held to the planned communuties act.  Open meetings!  Open records!

Representative Kevin Payne, District 21 (Sun City, A COMPANY TOWN!), is Prime sponsor for the bill.  This bill is not good for Sun City homeowners.  The planned communities act protects homeowners from bad boards of RCSC.  The RCSC boards will not be held accountable if HB2374 is passed.  It is unfair.

Our lawsuit is in discovery on many other counts, as well, and we have a court date set during the summer.

RCSC is trying to pull a fast one on the RCSC Members!  PLEASE HELP US DEFEAT THIS OUTRAGEOUS BILL THAT TRIES TO DEFEAT OUR LAWSUIT.  VOTE NO ON HB2374!

UPDATE: Defendant RCSC is trying to rig pending class action lawsuit!
FHA won't do mortgages in Sun City because of  RCSC transfer fees ($3,800), yet, Sun City's Senator Debbie Lesko was successful at getting the Legislature and the Governor to approve unlimited transfer fees on Sun City seniors.  Her bill got passed and signed!!! 

2/28/17:

A group of us caravaned down to the House of Representatives to give testimony in opposition to SB1175, transfer fees.  Defendant RCSC made Senator Debbie Lesko sponsor a bill that would "clarify" the law so that they could alter the outcome of one of our causes of action about the $3,500-PIF in our pending class action lawsuit.  The bill is retroactive to 2010!  

SB1175 PASSED THE SENATE UNANIMOUSLY WITHOUT DEBATE BECAUSE WE DIDN'T KNOW ABOUT IT AND DIDN'T SHOW UP TO OPPOSE.

When we found out, we started emailing and calling both the Senate and the House to tell them about what was behind the bill.  And when it was assigned to the House Commerce Committee, we all drove down there to give testimony. We made some headway.  One "NO" vote from a representative who is an attorney who thought changing laws during a lawsuit was a problem, one "PRESENT" who might vote "NO" on the floor. Others voted "DO PASS", though they said they might vote "NO" on the floor.  So, SB1175 is being sent to the RULES committee.  We must write the RULES committee and OPPOSE SB1175.  Our emailing list will get the info.

Keep calling the House of Representatives, especially the Rules committee.  We will object to this bill all the way to the Governor. You eat an elephant one bite at a time.

Subject: FHA is refusing loans because of the Preservation and Improvement Fee ("PIF").  Most concerning to seniors are the refinance and the reverse mortgages.

We must strike SB1175 at the House because it allows RCSC to levy unlimited PIF. Our RCSC lawsuit was filed in Superior Court on October 29, 2015.  It is ongoing. Senator Debbie Lesko is on the side of RCSC against the homeowners.  She got SB1175 passed out of the Senate that is intended to interfere with our pending litigation regarding the Preservation and Improvement Fee.  It will make the PIF legal retroactively to 2010, the statute of limitations! The Senate was never told the real reason behind the bill before they voted unanimously in favor. We have to kill this underhanded action by Senator Lesko in the House.  We must call the House of Representatives and tell them to VOTE NO ON SB1175!

Subject: This opinion piece is against Senator Debbie Lesko's bill SB1175 that is an attempt to interfere with our class-action lawsuit against the RCSC regarding the legality of charging the Preservation and Improvement fee.  The bill makes it legal RETROACTIVE to 2010!  Lesko is taking sides against the homeowners.  She doesn't have enough information to justify doing that.  Call the House of Representatives (click here for contact information) and tell them to vote NO on SB1175.  Let the court decide.

Subject: At the Sundial board meeting on Thursday, 5/28/15, RCSC voted to approve more million-dollar projects without a Membership vote against Article X of the RCSC Articles of Incorporation.  Also, there was finally a split between the board members where we finally have someone voting "no".  Director Dave Wieland complained that board members should not debate in public but instead at the secret work sessions where the members are shut out.  That action goes against the Planned Communities Act.  

We are going forward with a much-needed class action lawsuit against RCSC over many causes of action, including these two.  We have enough plaintiffs to qualify for a class action.  We will file during the summer.

UPDATE:  Changed our "motto" from "The Action of the Members" to "The Action of the Members, protecting Sun City's wallets".  With our upcoming class action lawsuit, we discovered SCFR is the only volunteer group in Sun City that is trying to control the spending and assessing (especially illegal) of the RCSC; this change more clearly defines our mission.  Coupling that with the Bulldog watchdog, we want the Members of RCSC to also become Members of SCFR by contributing to the "Anne Stewart Legal Fund" aka the "Bulldog War Chest" that pays for counsel to represent the Members of the RCSC corporation when the RCSC corporation is in non-compliance with state statutes and the community documents.  We will file our lawsuit when we deposit $30,000 in a trust account with our counsel Jonathan Dessaules.  See "About the Anne Stewart Legal Fund" for our progress in fundraising.

UPDATE circa May 2014--

Grand Avenue is again in the news.  ADOT is proposing changes at Bell/Grand Ave intersection.  Option A is a freeway-style overpass with on and off ramps.  We support this.  Our goal is to make Grand Ave a freeway where traffic from Wickenberg can continue on though the small towns to Phoenix, Sky Harbor airport or Tucson and back again.  The small towns want to keep traffic for the locals.  If this project is approved, Sun City needs to keep at it until there is an elevated freeway over Sun City with on and off ramps at 99th Av and 111th Av.  That would leave Grand Av beneath it to the locals with their golf carts, mobile wheelchairs and pedestrians.  Read our 2008 Grand Freeway Proposal.  Except for the contact information, it pretty much says it all.  What is true holds true forever.

Subject: The RCSC charged the bands rental and rehearsal fees that priced the non-profit clubs out of Sun City.  
 
The Anne Report: More money-grubbing tactics by the RCSC board of directors and management which are ruining Sun City and making it too expensive for members to participate.  Rental and guest fees are unequal member responsibilities that conflict with the articles of incorporation.  Guests are guests by definition so should be free since the member is charged, not the guest; and rental charges are unequal assessments since the members of the clubs have already paid their equal share toward the creation and maintenance of the facilities.  The facilities, equipment, and employees are already paid for a year in advance whether or not anyone uses them.  
     It is illegal for the board to write policies that conflict with the articles of incorporation which states all members have equal responsibilities.  The articles state the mission of the board is to act for the benefit of the members.  This rental/guest fee policy is not for the benefit of the members as evidenced by its causing a club to leave Sun City, with possibly more to follow.  
    The membership should be aware now more than ever before how important it is to establish a permanent legal fund to protect membership interests when boards act illegally.  The RCSC has systematically worked to thwart "the action of the members" other than lawsuit.  The members pay for insurance that will represent the board in litigation, but the insurance doesn't cover the members who bring action against RCSC wrongdoing.  The Sun City Formula Registry is the only group that has established a legal fund for that purpose.  Please contribute.  (Contributions are not tax deductible.)

We've added "About the RCSC Lawsuit" for materials and progress reports.  

Our attorney's letters have been ignored which leaves it up to the Members to file a class-action lawsuit.  As you know, the RCSC board and management feel confident in their silence since lawsuits cost money.  The RCSC has the Members' money to pay for their insurance policy that protects the board against the Members' interests.  It is up to the Members to finance their own representation.  The Members are now represented by counsel (Nancy Mangone, Esq.) and have a willing plaintiff (Anne Randall Stewart) to carry the class-action lawsuit forward.  We need continued financial support to complete the endeavor.

No elected board should be permitted to disobey state statutes and the community documents.  Only civil litigation will compel compliance.  We cannot call Sheriff Joe to help us.  The Members must step up and get it done once and for all. 

We're going door-to-door in our fundraising effort and appreciate your courtesy when we meet you in person.  Thanks for your support!

Viewpoint Lake clears state regulatory hurdle

Subject: Jan Ek admits to "secretly" working with ADWR to get breaks in the water allocation for Viewpoint Lake if the RCSC installs irrigation systems on some golf courses and teaches the members to conserve water.  Sounds good on the surface, but we want to see documentation.  Secrecy is one of the claims in the lawsuit against the RCSC.  After 30 years, the Lake needs to be relined and the RCSC has the money in hand to get it done.  This "secret" action by Jan Ek is being used to let the RCSC off the hook to live up to their contractual obligations to fix the lake.

Subject: The RCSC ignored SCFR attorney Nancy Mangone's August 22, 2012, letter that alleged the RCSC is not in compliance with state statutes and its own community documents.  The board illegally increased the quorum for membership meetings and then discontinued a director-member exchange meeting.  After receiving Mangone's letter the RCSC proceeded to eliminate quarterly membership meetings and approve multi-million-dollar projects without a membership vote.  These actions indicate they are not going to discuss compliance.  
     There are more than these causes of action.  It is time to argue our numerous complaints in court.  As a result, Anne Randall Stewart is collecting the funds needed to go all the way to the appeals court, if necessary.

m at the RCSC.  Director Bill Pearson is worried now the board will have to come up with something to thwart their idea.  There will be a Director/Member Exchange meeting at Lakeview Center at 9 a.m. on Monday, January 14 where you can go to support the music clubs' idea.

 On January 10, 2013, Anne Randall Stewart received a letter from the new RCSC President James Brasher threatening and intimidating her.  (And the beat goes on...)

We suspect this to be another frame-up job.  They framed her twice before with false charges and said if there was a third time it would mean permanent expulsion.  

Anne Randall Stewart has obeyed every rule the board has thrown at the members even if they are illegal rules.  Permanent expulsion might mean she could not bring a lawsuit against the RCSC because she is not a member in good standing.  It would not behoove her to disobey the rules and forfeit her "member in good standing" status.

The letter accused her of circulating flyers on car windshields at the RCSC parking lots.  Friends of the Registry have been instructed to obey the rules (BP #11 and #14).  The Registry members circulate person-to-person, friend-to-friend.  Even though we believe BP #11 AND #14 go against the articles of incorporation because they thwart "the action of the Members", until we go to court to challenge them, we must abide by the rules.

The person(s) guilty of this "crime" is either ignorant of the rules or is trying to get Anne Randall Stewart into "trouble".  By the way, there was no flyer enclosed with the RCSC letter even though the body of letter said there was.

The RCSC is sneaking a $6-million project through without a membership vote.  There wasn't 10 days notice.  Article X of the Articles of Incorporation mandates a membership vote for any "indebtedness or liability, direct or contingent, over $750,000".  It's a North Golf Course reconstruction project led by a man who has never done a golf course before coming here.  $2 million just for the irrigation system alone.  $6 million for a golf operation that has drainage ditches instead of golf course water features of Del Webb quality.  Remember the silk purse and sow's ear saying?

The members showed up to protest the demise of the bands and dance clubs but the board wouldn't listen.  We can hold another protest on Dec. 20, 9 a.m., Sundial Auditorium.

The crux of the problem: "Guest must pay to use the facilities."  That principle is ruining Sun City.  That principle eliminates the participation of the members with not enough money to pay extra to enjoy the facilities with their family and friends in order to show them around to entice them to move here.  There is no need to charge members more.  The facilities are already paid for a year in advance by the annual assessments.  Charging fees only allows the elites to use the facilities while they gouge the poor to foot the bill for them.

The facilities are for the enjoyment of all.  They create a sense of community and were originally established as a marketing tool.  The solution to the problem is to eliminate all guest fees.  Try it and see how enjoyment will flourish and the members will be happier.

On September 27, 2012, Noel Kasper delivered a letter to the RCSC at a board meeting requesting a petition to bring to a membership ballot vote the issue of saving the Quarterly Membership meetings and the bi-monthly Director/Member Exchange meetings.  Here is the RCSC response by President Vance Coleman.  In his letter dated Oct. 1, 2012, Coleman admits that the board voted for "Motion #1" at the last board meeting despite our petition request.  ("Motion #1" removed one of two bi-monthly Director/Member Exchange meetings.)  With our membership action to bring the issue to a membership vote, the board did not act in the membership interest when it refused to table the motion until the outcome of the petition drive.

The RCSC appointed Craig Brown to fill a vacancy on the board.  The members voted him off the board in 2010.  He was responsible for the demise of the legal committee.  He led the quorum increase that ended membership meetings.  This is a slap in the members' faces.  Because of Brown we have to take the quorum issue to court.  He should step down.

Subject: The RCSC appointed Craig Brown to the board.  The members kept him from getting re-elected in 2010.  He stopped the legal committee and then raised the quorum for membership meetings which is causing us to head to court for relief.  He raised the quorum when the members had quorums protesting the increase in the PIF from $2,500 to $3,000 in a bad real estate market and also the raising of the quorum!  Attend the membership meeting on January 26, at 9 a.m. at Sundial Auditorium to protest that and their other actions that put the homeowners at risk of litigation. Subject: RCSC dishonoring long-term contracts.  The RCSC is protesting a 14-percent increase in utility rates (which we do as well) yet increased assessments of over 100 percent on Sun City's pioneers!  They should practice what they preach.  Protest at ACC hearing Oct 7, 10 a.m., Sundial Auditorium.  Also, attend sundial monument dedication at 8:30 a.m. the same morning.  The Sun City Formula Registry requested petitions to save it which halted its immediate demolition.  We thank the RCSC for listening to the members.

FAQ 

Is The Daily News-Sun covering Anne Randall Stewart and The Sun City Formula Registry fairly?

Yes, from our perspective.  Of course, The Daily News-Sun must report what our detractors say, but we expect that.  Whenever one deals in opinion, the room divides.  Freedom of speech is the cornerstone of democracy.  The more opinions the better.  Sun City needs to have all opinions aired before allowing a volunteer layman board of nine (actually five since majority rules) to "tax and spend" with our security on the line.  Most Sun Citians live on pensions and social security.  We need accountability over folks handling millions of dollars.  Otherwise, greed can thrive in a cold corporate environment.  We often hear from people with those tendencies, "If you don't like it, move."  That's a litmus test in our book for targeting the culprits for increased scrunity.

In response to our criticism that the RCSC has not convened the Legal Committee and, in closed session, created bylaws and board policies that negatively impact the members, i.e., 100% assessment increases, membership meeting quorum increases to 1250, etc., THEY HAVE OFFICIALLY CLOSED THE LEGAL COMMITTEE!!!

Instead, they are establishing the new GOVERNMENT AFFAIRS COMMITTEE!

They are going to monitor the bills down at the Arizona legislature so that they can continue to NOT OBEY THE PLANNED COMMUNITIES ACT REGULATIONS while they get the "common area" property tax breaks that are given to planned communities.

THEY WANT IT BOTH WAYS! 

They don't want open meetings, open records, and a recall with a thousands signatures, etc.

Contact the board and tell them you are against this change. "KEEP THE LEGAL COMMITTEE!" "Start discussing changes to the bylaws and board policies in open meetings!"

The RCSC Board of directors are strangling the members. They are totally emasculating the members. They now have given themselves the ability to charge the members whatever they want WITHOUT LIMIT and the MEMBERS CANNOT STOP THEM.

The board is voting to accomplish these bylaws changes at the next board meeting.

Subject: Without an open meeting, the RCSC board "voted" to repair the Sundial Monument instead of demolish the Del Webb icon.  That is a victory for the Members.  However, we must hold off on our celebration.  Without a public vote, board decisions are not official.  Our petition drive isn't over yet.  Stand by until the board's decision is official.  No demolition can proceed while there is a request for a petition for membership action through a Membership Vote.  See PRESS RELEASE BELOW.

"Save the Sundial Monument" Speech

 

2/17/11:

"Sundial Monument rust a ruse" by Anne Randall Stewart, Spokesperson for The Sun City Formula Registry

Subject: Without discussion in an open meeting, the RCSC board had a press release that because of rust on the Sundial Monument it will be removed, citing an engineering report that it is "unsafe".  We found that to not be the case; the steel frame is not any rustier than the new steel found at a construction site.  The steel is still good.  The Sundial Monument is a historic landmark and namesake for the Sundial Rec Center.  It is an icon and necessary for the branding of Sun City.  The Del Webb history is important to perpetuate "Our Retirement Dream Come True".  After this letter was circulated, and others generated from member outrage, the board released a second notice that backed off saying they don't have enough information to tear it down and is requesting "input".  We don't trust them.  Leave the Sundial Monument where it is and take care of it.  And start having open meetings so we don't upset the membership.

"Judge denies country club claim"  Sun City Independent, February 16, 2011; Front Page and Page 7, by Rusty Bradshaw

  
Subject: The Union Hills homeowners fought back in court and won to protect their property rights to keep the Union Hills golf course a golf course according to the golf course covenants.  Their victory is a victory for all golf course adjoining property owners.  With the recent attempt to turn Quail Run into a dog park, the RCSC was watching this case with interest.  First a dog park, then condo development with $5,000/unit fees from the builder, $3,000 PIF/unit from the owners every time the deed changes hands, and a $432-per-unit annual assessment.  Ka-ching!  Ka-ching!  And Sun City will no longer be what Del Webb donated to us: "Our Retirement Dream Come True".  Instead of homes on or near a golf course, there would be high-density housing like every other community surrouunding Sun City.  
 
 
 
We thank the Union Hills homeowners for their courage in the face of expensive litigation.  We're sure the elderly living there on Social Security were scared out of their wits.  Shame on the Union Hills Country Club for tormenting them with a lawsuit which looked to us to be a coercive tactic to get them to sign off to allow condo development.  SHAME.

Subject: RCSC is paying people to use our facilities for free!  In a January 14 Memo from Jan Ek, employees can use the rec centers for free, including golf.  Even part-timers can play golf for $2 which is less than what the members pay.  The members are not being treated as well as outsiders.  Start attending membership meetings until we reach 1250 quorum.  Attend regularly every quarter.  Next meeting January 27 at 9am Sundial Auditorium.

The country club is coercing the adjoining golf course property owners to sign away their deed restrictions so that they can open up the golf course for condo development.  If they get away with it, we fear the RCSC will follow suit.  Remember when they tried to close Quail Run but came across the deed restrictions that prevented it?  If the money grubbers can start dense development, Sun City will never be the same quiet golf course community it has been for 50 years, where everybody lives on or near a golf course.

Subject: The board increased the membership meeting quorum from 100 to 3500, ending membership meetings. A petition drive ensued to remove the power of the board to write bylaws or board policies without membership approval.  A bylaw was then written to reduce the time from six month to three to get 3600 signatures and forbidding petition or flyer circulation on RCSC property.  These changes doom to failure any effort to have a successful petition drive.  Now, the board is trying to cover its tracks by "re-addressing" the quorum issue that stirred up all the trouble in the first place.  They should re-address all of their actions like increasing the PIF to $3000 and removing the rights of CCW permit holders rights to self-protection.

Subject: The Sun City Formula Registry rejects the recall petition {Petition P-03] that the RCSC approved because Vance Coleman's name wasn't included and changed the start date from March 29 to Oct 1 when the homeowners return from summer hiatus.  SCFR's request for the board to stop the recall by rescinding their past actions that interfered with membership action was ignored.  The RCSC increased the quorum for membership meetings to 3600, decreased the deadline for petition circulation from six months to three, closed the facilities to petition and flyer circulation and debating the issues in the Sun Views.  Petitions P-01 and P-02 that will amend the articles to remove board power to recall board members and write bylaws and board policies without a membership vote of ratification is continuing at the dog park, daily Noon-2p.

UPDATE 4/6/2010: 
On March 29, 2010, Noel Kasper rejected Petition P-03 to recall the board as to "form and timing."  He requested Vance Coleman be added and that the recall start on Oct. 1st.  The reason for the recall is the board's thwarting of "the action of Members" which is guaranteed by the RCSC Articles of Incorporation to prevail in a dispute between the Members and the board as to the bylaws, etc.  Contrary to the best interests of the Members, the board increased the Membership meeting quorum to 3600, decreased the deadline for petition circulation from six months to three, refused access to the facilities for petition and flyer circulation, and refused debate of the issues in the Sun Views.

Subject: The RCSC board voted to raise assessments from $300 to $1000 on Viewpoint Lake homeowners who, consequently, filed suit over it.  The RCSC board claimed a 30-year old agreement was "unenforceable," but the judge said it was.  The RCSC lost and the agreement stands.  The board vacations in July and will decide whether or not to appeal in August when they return.  Their modus operandi is to keep appealing until the homeowners run out of money to fight them.  This method has been very effective in the past and intimidates homeowners from challenging them in the future.

Subject: The RCSC board voted unanimously to remove board member Ann Ullman.  The Sun City Formula Registry opposes the removal.  Ms. Ullman is the sole dissenting vote on the board and as such should be allowed to remain and represent her dissenting positions.  The RCSC articles of incorporation allows 6 board members to remove the other 3 if in its opinion they are incapable of performing their duties.  For a decade the SCFR has warned the membership of the danger of this article to control dissenting views through the oppression by threat of recall by the two-thirds vote.  SCFR urges the membership to join in protest and vote to change this article.  If the board wishes to recall a board member, it MUST be brought to a vote of the membership.

Subject: RCSC board wants gutters on Willowcreek costing $435,000.  Stewart wants Pacific Aquascape to be able to bid on the project to keep Willowcreek Del Webb quality.  She fears they will be shut out by specs calling for a gutter which they don't do.  If they are, Stewart calls for recall of board members and dismissal of employees in support of it.
UPDATE: Pacific Aquascape was shut out of bidding.  On Monday, at the 4/6/09 board meeting, Tom Beckwith delivered a PA bid for $203,000 or $308,000 depending on the length, which was immediately rejected.
So, Willowcreek will get a gutter instead of a water feature and it will be done by Alliance, a first-time contractor, with no identifiers on their trucks at the construction site.

UPDATE 3/25/09:
Allegedly, there was a settlement check for $4.3 million, which was not confirmed or denied by the RCSC board.  Allegedly, the repairs to the Sundial roof came in at $4.5 million, and there was an additional $1 million spent on upgrades without a membership vote.  The board is "hush-hush" because they claim "sanctions" will be levied against them by Cincinnati Insurance if the amount received became "public."
